I wanted to say Thank You for all of the responses and support. I may end up losing my money in the long run, but at least people are aware of his actions. I do plan to sue him in small claims court.

You can sue him in small claims court and win you can guarnishee his checking or savings accounts to get your money, but unless you know where his money is you only have a victory for winning the case. I say try and get your property back!

How would that work if he is out of state?

You can file in small claims court in the locality in which he resides. Often you can find the forms (Small Claims form, $45 here in NC, and Service of Process form, $5 here in NC) for doing this online, fill them out, and mail them into the court and with the filing fees. The problem is, you will need to either appear in court on the court date, with evidence, or possibly hire an attorney and submit an affidavit along with the evidence.
