Just reading what you stated I would be cautious. There is no reason he can not send the title signed without the information fill in to his attorney. This is done on a daily basis at many car dealers. Then when the money changes hand and the car is in your possession you have the title.

Remember attorneys are people too so they are not above any one on the street and need to be viewed with caution as you would anyone you don't know. Unless the deal is so unbelievable and the car so fine I would think twice based on your information. Good luck with what ever you decide.

You are not being unreasonable. If you pay cash, you have every reason to expect to get a title. End of story!

This is a classic case of a lawyer earning his money. His advise is right on. You're paying for it, I'd follow it. If the seller has a problem with it, find another Viper...

This sounds way too fishy to me. Ask him why you can't pick up the title if you bring a cashiers check. If he has a power of attorney to sign the title, he should be able to sign the odometer statement. When deals sound too good to be true, they usually are, but this transaction sounds like they control everything and you have nothing to show for it.

I got a letter from a man in Nigeria asking me to open an account so he could transfer millions of dollars into it.

I thought that scam had died out a long time ago.

Once he has the money, your position is weakened significantly if there are any problems.

I don't think I have ever disagreed with our guru, Jon B, but on this issue I am afraid I will extoll the other views even more strongly. We do around 1300 cars a month with our 3 dealerships, and I did Finance for the Woodhouse Corp. for 5 years. The concern is based on the fact that every state has very different rules. You can have all the paper trail you want in many states and if you don't receive a title, you can not apply for a lost title - only the original owner can. Though this is not true in all states, it is in too many to enumerate. Stand firm, demand a title with a cashier's check,as the buyer is not even in the country. As large as we are we have been burned on a couple of situations like this, and even with our attorneys there are a couple outstanding. Don't take a risk with all the other variables in this situation, especially with it being transacted between two states.
