CA IMPOUNDS COMING......BEWARE

Some of you may not know this but California passed a law (effective Sep 2002), which allows impounds of vehicles (for up to 30 days), for those caught in displays of speed, including speed contests, burning rubber, turning donuts (?)(as opposed to eating them, I guess) reckless driving, etc. I cannot sleep at night thinking of my Viper "hooked" to a tow truck, and sitting in some "jammed up", unprotected, impound yard for all to ravish. May have to have my attorney ride with me. Beware!

The nice thing about these new laws is your car is gone, your in jail for the night, all based on what one "good" cop said you did, and you have not been convicted of anything.

No, there is no clear definition. It is up to the officer to decide. I have already been stopped for this. I was accelerating a little too fast for the officers' liking. Mind you, I was not over the speed limit at any time.

Actually, I think the display of speed thing is probably a reaction to street racers. It's probably hard for a cop to say that someone was racing. He could just grab one of the offenders and say that they were displaying some kind of power or speed.
The normal folks in California really need to get political and get some power back from the alarmist "greens", "anti smokers", "anti drinkers" and all the other special interest nut case power groups who constantly bring pressure to enact laws limiting the rights of normal people. The way the legal system is supposed to work in the USA is something like this, break the law and you get arrested or get a ticket, defend yourself in court, if convicted then they take your car or your license or send you to jail or take some of your money. They are not supposed to take things away from you before your day in court.

That's right! We need another law.

1. Any vehicle with children up to the age of 18 must travel in the immediate right hand lane and is not allwoed to exceed a speed of 45 mph or the minimum speed allowed on the highway in use.

2. Children are not allowed in vehicles during rush hour traffic.

3. Children are not allowed in vehicles between the hours of 7pm and 6am.

Violation of these any one or all laws will result in permanent 10 year suspension of license, $10,000 fine, 30 days incarceration and indefinite vehicle impoundment.

And please register all children with your local authorities so they can have their ID number tattooed.

I can't say I totally disagree with the law cracking down on street racing, or doing donuts in crowed cities, etc...IF there
is plenty of evidence to support this is really a problem versus just annoying someone/some group with the right connections...

However, the authority given to the cops in this case really crosses a line....That is what scares me...So if I get a little aggressive on an empty on ramp, then merge onto the fwy at normal speeds, I could end up in the slammer!!!

Normally, I don't side with the ACLU, nor like those people in general.

But if there was ever a time to rally support for the protection of our Constitutional rights to due process, then this is it. I'm gonna cantact the ACLU and see if they (we) can fight this in court.

Yeah, I would put about 0 stock in them helping, but maybe worth a shot. It sounds like this law is like the DUI laws we have in IL. If you are suspected of driving drunk and refuse to take the breathalizer, you automatically lose your license.


No court needed!!! That has been in effect for years.

CA Regions need to start a letter writing campaign, to their legislators, on this matter. Need to have specific guidelines on what authority the police have to impound. This cannot be left up to a police officer, and we need alternatives. The officer may not like the way you look, or may be jealous of your car, or heard a "story" about you. Let's don't go to "sleep" on this matter, otherwise this site will be filled with "sad" stories.

I believe Bill Lundeen pointed this out a few months back. Red... I mean Gray Davis signed this joke of a bill into law. I can't believe he got voted back into office! He also signed a bill that makes having exhausts louder than 95 db? a crime. We are definitely going to have harder times out here. So much so that it will make driving your car a hassle instead of an enjoyable experience.

P.S. Beware the traffic enforcement cop (meter maids) in San Diego. As I hear, the SDPD refuse to right traffic infraction tickets at this time due to the city currently not having a contract with them. This and the impending layoffs have forced them into protest. Most regular SDPD don't write BS tickets. The meter maids who are now patrolling write BS tickets left and right. The night before xmas eve I got pulled over for not stopping at a stop sign. I refuted, saying I stopped long enough to look left and right before I proceeded. I was at his mercy because of his definition of how long a stop should take.

A fast if not the fastest growing source of revenues for police agencies come from forfietures, the confistication and sale of private property expropriated under such laws. Vehicles used in drug busts, prostitution solicitations etc. have been confisticated and sold even when the registered owner was not involved and knew nothing of the offense. We keep the car, you keep the payments. Yet the police can't even be prosecuted when they kill innocent bystanders in reckless chases, we've all seen them speed through our neighborhoods with no lights or sirens on a doughnut run. Then the police wonder why they lose the support of previously supportive citizens. I'm a law and order kind of guy and it kills me to see this happen to the folks that protect us all.

The cops used to target the ricers here at a car meet until the kids got into the computers and had a little fun. They had given the kids their names & signatures (I imagine citations and driver's licenses carry a good fingerprint as well) and let them see their faces, might as well of handed over a credit report at the same time. The harrasment stopped. Of course there are no computer fr3aks in California...

That exact thing happened to me. Clear on ramp, wound out second gear and merged onto freeway at the speed limit and got pulled over by a motorcycle cop. Gave me a lecture and a warning, meanwhile I didn't break any laws.

Was told that Georgia has a similar BS law. My son was pulled over in his school parking lot for reving the engine on the Viper. Some 25k a year crossing guard called it in. Yes, I did inform my son he was wrong. Not for doing it, but doing it in front of a police officer. We live in a small town- so there would be the jealousy factor since my son is only seventeen. Too many laws, enforced by losers.
