My neighbor goes out and buys to his collection of cars a Ferrari TS512, the new Stradale 360 and the new Ford GT....SO he gets both cars and is waiting for the GT. The dealer in the Bronx calls him up and tells him that after they detailed the car, one of the sales person went to gas it up. Guess what? They hit the car!!!. Pretty much totalled it.Now he doesn't want his money back and wants a new one. They tell him that it will cost him additional $45,000 since prices went up from the time he ordered his car. This guy is freaking. Got a lawyer involved. gt COST HIM $240,000!!!Good luck...I will try to take some pics of the FERRARIS today if the snow is ok.....

You mean they want $ 45 ontop of $ 240 to replace the car? I know a guy that was told he could have a local dealers 1st. GT for $ 90 K over sticker which is $ 240, and he said forget it, so that's about the going price (way too high anyway). A deals is a deal and if they didn't deliver the car then they will have to replace it. It just will probably take awhile. The dealer is getting it from another dealer and splitting the $ 90K over sticker sounds like.

The dealerships insurance company should cover most of that difference. If the price of the car has gone up that much, it should increase what the wrecked one is worth. That is provided the cars are similar (No major changes in powertrain/body).

He should also collect interest on the money he deposited on the car.

The last five or so GTs sold on eBay went for about $220,000 each. (And prices are slowly coming down) If someone is paying more than that, they aren't doing their due diligence.

***** about that guys car...

There was a story in Autoweek within the past month describing this scenario. I am assuming this is the same guy.

That's right "Finally",
You and old cynical Joe are both thinking the same thing.

The dealer made the first deal before he had any idea how much extra he could get for the car.

He probably made up the bogus wreck story just to get out of the deal.

If I were your neighbor. I would be thinking fraud, not just a breach of contract.

Wonder if the dealer would like to see the wreaked car on a flat bed parading infront with some politically correct signs. He can do this during legal action also.

Ok, lets say the wreck was real.

What has this wreck got to do with the contract that your neighbor had with the dealer?
I can't believe that the contract and deposit was for a certain VIN.

So, the dealer should have called your neighbor and said, "we can't deliver yet, it will be a few more months/weeks".
The wreck shouldn't have anything to do with it.

Now,
The way I remember contracts with car dealers, the contract is written so the dealer can bow out if he wants to.
You can't, he can.

I don't really know anything about contract law, bet that's the way I remember it.

As for the extra 45K, Dealer broke it, Dealer must replace it. Lawyer will win, Dealer will loose. As for fixing it? I saw the one cut in half (lengthways) at the autoshow (pretty neat display), feel sorry for anyone that smacks up one of these, very likely the monocoupe will be damaged, how fix? replace! Where get parts? in your dreams..............

Finding another GT to replace it will be a challenge as all GT's are on recall for suspensions (A-Arm's) that can brake anywho. If Dealer had one, he can't sell it, and if your buddy had it, he couldn't drive it. LOL

Joe

we are talking about the GT Ford. It's not like thye make many of them and someone is going to lose out on the production line if they replace his vehicle right away. They wanna return his deposit because they are saying that Ford is charging them more.Thats BS for a fact because the dealer knows he will get more on the next GT that comes in...

Wow, haven't visited this site in months. If I were the guy I'd skip the lawyer and just shoot someone.

It doesn't matter what the current market price is for the GT, the fact is dealers get the car for dealer cost from Ford Motor Company and that price does not change for the given model year. Only problem is the dealers were only alloted maybe 2 Ford GT's max if they got any GT's at all. So maybe the dealer would have to make a deal with another Ford dealer to get a replacement GT. Even if this is so they should eat the cost since they already gouged the buyer for $100,000+ on the first GT and they are the ones that wrecked it.

If the car was red and purchased from a dealer in Yonkers, a pic of the car made the last page of Autoweek a few weeks back. It was really messed up in front, the caption read "and you know that won't rub out".....

What a disaster. Perhaps he'd have more luck pursuing the matter through Ford. Clearly the top dealers get dibs on the GTs and quite doubtful that this dealer can get another, especially after the sales manager misbehaved so badly. Ford may want to make nice.

FYI, sorry about all the deletes, still new to the site and wanted to hit "quote" instead.....

Anyway,Could not agree more...... Why are people buying these GT's new like that?? Check autotrader.com. There are SEVERAL for in the $210k-$220k range...., with VERY minimal mileage(some under 100 miles) And I presume they will only fall from there. Anytime a dealer marks a car up THAT MUCH. Its usually based on hype, and very unhealthy for resale... Yes, I know a Ford GT is a super rare car. But is there really that much demand for one??

I know a guy who bought a 1990 Corvette ZR-1, back in late 89' for a "whopping" $91,000... He never drove the car, kept it stored... In 1995 I think it had 150 miles on it... Do you know what that car is worth today?? About $30,000 ON A GOOD DAY... No thank you....

Anyway, That really *****, I hate reading these stores....

Bottom line..... Its a very rare opportunity, that ford dealers get, to make this kind of profit, on a new car. So, they figure, screw em'.. We'll never have to deal with them again.... Lets make as much as we can, now... There are some good guys out there in the car business. But most dealers could care less. sad, but true.....

I still think that if one were to read the fine print in the contract, there would be a clause letting the dealer bail out.

I believe the dealer will be able to return the deposit and walk away.
