Update to Wreck (lucky me post).

Well since the previous post (http://forums.viperclub.org/rt-10-gts-discussions/627414-lucky-me-wreck.html) was closed I am starting a new one to update those who questioned the accident. Police embedded.
After dealing with the other guys insurance (state farm) for over a week leaving messages, my insurance got in touch with them yesterday and they have denied my claim. It was a *** moment when i was told this. They are blaming the accident on the car I initially pulled over for to help. Bunch of BS and my insurance (Geico) will present them with a bill and if they deny that, which i m sure they will... it will go to attrition which is a third party made up of lawyers/legal folks to determine the outcome. Right now my car is at a total lot (Car is totalled), with inspection, on Tuesday and let me know how much they will pay out plus mods. Whatever they dont cover, Ill remove and sell i guess. Glad I had a good portion of the mods as itemized items on my insurance (which I paid extra for), so I might get d'ed to bad....hopefully.

Unbelievable. I thought whenever someone hits someone from the rear or when parked it was automatically their fault. Something about you're always supposed to be in control of your car. State Farm will never get my insurance business, that's for sure.

That's a pain in the butt... Hopefully you got the other guy's information and gave it to Geico just in case State Farm doesn't budge. I'm pretty surprised that someone can just hit you from the rear and it isn't their fault - even though you were off to the side of the road. I wonder what State Farm said to the guy who hit you - it would surprise me if they told him that they'd happily go after that other car that you stopped to help and not charge him the deductible on his policy. I'd ask for them to verify how they're dealing with his claim - it would seem unfair for them to treat the different parties of the same accident differently.

<p>It wouldn't take me more than a couple of seconds to decide to have my own attorney jump into this situation if I were in your shoes...letting an accomplished pro run the deal is a great comfort AND, in my experience/opinion, offers the greatest chance &quot;to be made whole&quot; and is therefore the only way to go.</p>

If insurance doesnt' cover all the mods, my mods will be coming up for sale depending on how much is done on the next viper i get. I m currently looking at another supercharged GTS (Grey) which has everything done to it (GTS-R 001 actually, if he doesnt sell it before I get my settlement check) or a SRT supercharged coupe but the look of the GTS is hard to pass on.

I know you meant "arbitration" and not "attrition" but the settlement will likely be something in the middle (between what you think and what they think.) It won't cover everything - it will be shared pain with you and the other guy. I never thought I would say this, but you really should get legal counsel involved. I bet the lawyer pays for him/herself.

I would let it play out some more to see if this is normal insurance company wrangling. I wouldn't care which insurance company pays out. No offense to anyone here; but, to me, the LAST resort for me would be to get involved with a lawyer.

Great ! I didn't really understand why there was a need for a lawyer on your part from what had been described. It sounds like the normal things that go on between insurance companies.

I would do two things.... Get a lawyer... Call JonB...

A few years ago, I had to deal with a totaled Prowler. A 90 year old lady hit me in the drivers side wheel. BOTH insurance companies low balled my car. It was paid for, in excellent condition and they thought they could get away with low $.

I had the atty. because I also had injuries, with 2 phone calls he had the Insurance companies in line with what the value of the car was. Without those phone calls, I would not have gotten the value from my car.

Call JonB, he has helped many owners here get top value out of their car.

state farm has a history of denying claims, and most of their claim checks are written on the courthouse steps.

I have been an ins agent (independent) for 11 yrs, and while they're not the only bad one, they are the worst from my experience.

good thing you had geico.

Sorry to hear about your loss, Did the front of the car get smashed up too?

From what I have seen written on other threds, Mr Jon B should be able to help you with the true value of the car, Good luck, at least youre OK
