Can you really beat a Ticket !

We’ve all gotten these before and this is not one of pity for me but I've got to fight this one. I got this one yesterday (I was in the Viper). Ticket is for a 89/65. Funny thing was when he pulled me over he said I was doing 96 97 (he said both) (I really wasn't). Asked me "why such a rush?" I could tell by his demeanor that it wasn't going to be pretty. He asked me back to his car. Said he didn't know if it was cologne or? But he thought he smelled alcohol (it's 3:00 in aft). I was chewing gum. He asked if I could spit it out. I did thinking he was going to give me a sobriety test (he didn't). He then said depending on my driving record it would determine what he did. Long story short I had one ticket three years ago (2 points) and he then said he was going to help me out by issuing the 89 in a 65. He then went on to say he was doing me a favor and 24 over was only 4 points on my license and I could be receiving one that could be 6 points. You know you're at their mercy so I decided to say little. I did however asked where he came from (he replied from the north-I was going south)
And noticing his radar gun I asked to see my speed. He said he cleared it :rolleyes:
OK well thank you very much as he handed me my ticket.

Truth: I was speeding. I wasn't going any faster than the 10 cars around me. I did feel singled out. We were doing probably at best 80. I will seek a lawyer and fight this at all cost. I just want to know has anyone else had any success? Can you really beat a ticket? I forgot to mention the courthouse is not in my backyard. Do you use your lawyer or get one in that area. You know Home team advantage. What do you think?

Of course you can beat it.
Will cost you about 500$.
Your choice whether that's worth it or not.
Use a traffic lawyer from the court district where you got pulled over. They will know the pig and how to deal with it.

Every ticket I've gotten has gotten dropped or reduced in court one way or another.

First off, many times the officers do not even show up for such low end offenses. When he isn't there to defend himself, it usually ends in just a fine.

Also, if you claim not guilty, many times they will plea bargain and settle at a lower speed.

Lawyer may not be worth all the fees.

I agree with Tim, I received two tickets 4 years ago that I did not deserve. I contested them both. In court I asked the judge to make the officer show me his most recent recertification for operating the radar gun and he could not.
The judge dismissed the ticket and told the officer to get his certification up to date.

It's my understanding they have to show you the radar speed? But I could be wrong.

I hate it when they say, 'I'll help you out' by doing this or that. While being held in some room where they handcuff you to the bench, I overheard the arresting officer talking to the District Attorney in the other room on the phone. This all happened after he reads me the law from some book regarding reckless driving and drag racing. It was 1 a.m. in the morning so I guess he called him to see if he could ticket me for drag racing. I heard him say, 'Oh, so I can only ticket him for speeding?' and so on. He comes back and says it's my lucky day and that he's going to do me a huge favor by not giving me a ticket for drag racing and how much of a nice guy he was. After that incident it's hard to believe these guys sometimes. He ended up giving me a 50mph in a 35mph ticket and for tire noise. I didn't want to argue at that point about the tire noise because I was in my Vette and had traction control on so I know it wasn't me. It was my friend in his M3 :mad:

89 in a 55mph,Racing, reckless driving,106 in a 65mph, and various others that I have received. If you get the right lawyer your record can look like mine. NO tickets!!!!! BUT it will cost you.

I've had 4 tickets in the first 2 years I had my car, all are gone thanks to a lawyer. Why take the points?

Try Russell A Warren, Attorney at Law 1221 Locust Street, St Louis MO 63103, 314-621-3259. He helped me in Illinois and was very reasonable and good. Paid a fine and got no pointsif I did not violate again within 3 months. I didn't.

I shouldn't say this , but I have not had a ticket in over 10 years, but my wife has, and here in Florida it will cost you about $125 for a lawyer that has a no point/not guilty guarantee. So far 100% success.
Good luck, and fight it all the way. It is the principle of the matter to me.

I actually just ran into a similar situation. My first Viper Speeding ticket and I don't even own one yet. I was driving our region president, Dave Dugal's 97 blue/white GTS just doing the same speed as the other 15-20 cars around us, don't know exactly how fast as we were talking at the time. We crested a hill and boom, the V1 started telling me to slow the hell down, it was Laser, the death beam. He wrote the ticket for 80 in a 65, but I doubt I was doing that much. I REALLY can't afford to have the points on my license or the insurance hike. When I rolled down the window the trooper said "big surprise but you were speeding." He definately singled out the high profile car. I am almost 19 and have had my license for 2 1/2 years with no offenses. This was a complete speed trap, the cruisers were barely visible from the roadway as they were hidden behind trees. Any advice on what to do? I don't think I can afford $500 for a lawyer.

That *****. Ask me how I know. I believe they are required to show you the speed reading if you ask. That crap about "clearing" it out went out about twenty years ago when they started recording all the radar data on tape or hard drive right there in the car. He's jerking you off and you should call him on it in court.

The answers to all these questions vary dramatically from state to state....even county to county. Don't assume that if you got off with a lawyer in Florida that you can in Illinois. Of course it's different, but in NYC you MAY get a ticket reduced, but, unless there is an obvious mistake (like you're driving a Red Viper and the cop writes you up as a blue station wagon) you will NOT get off!

Thanks for the advice. I looked into it today. I'm getting a lawyer. It's worth it to me just to keep my points where they are. I look at it this way it will cost me in the long run(insurance). Finally got it - I need your lawyers phone #. You know I just find it funny that they can write whatever they want on the ticket. I mean if I was doing 96 in a 65 like he said I was - why not write it that way. Why the bargaining you are just compromising yourself when you do that.

The best thing is not getting caught in the first place,2nd contact the town prosecuter for the jurisdiction.Tell them you are looking for an alternative to hiring a lawyer and fighting it.Agree/suggest non-moving violations as in 4, $50.00 parking tickets.The jurisdiction keeps all the money and doesn't have to send up to the state or the county and you get no points.Has worked for me in the past and recently.
