Convertable Top Latch- 2004 Vert

Is the convertible top latch suppose to remain in the unlatched position after removing convertible top? Mine i believe used too and now it wont stay locked in the unlatched position. My dealer says its suppose to be like this. Either im nuts or he is? Help

go to a different dealership! it's supposed to close all the way
