Basically, he didn't do his homework on purchasing this viper. Then makes this post for all to feel sorry for him. I'm calling him out on this one. WHY IN THE WORLD WOULD YOU NOT TALK TO THE GM OF THE DEALERSHIP BUYING A CAR UNSEEN ??????? Hey, have at me but the OP has not a clue how to purchase a highend car sight unseen.

OMG..are you for real? Who the heck's coolaid you been drinking??? IT IS A NEW CAR!!!! The dealership screwed up..not the buyer! How you rationalize this is the buyer's fault is UNFREAKIN believable! The dealer sold him a NEW car telling him it was perfect...and it was not. How do you compute that the buyer got what he deserved? Maybe there is a forum for dealerships you should join. I hope every new car you ever buy is perfect and never fails...because if it isn't, using your logic, it's your fault!

The more I read this, I didn't notice you named the salesman by name. Dude this kid has a nice case to sue you for defamation. You went and posted his name on social media, REALLY?????? I'm going to make a call to let this kid know and be aware what your doing. Your decisions are so apparent to why your in the situation you in.

"a nice case to sue you for defamation" WANTED, you might want to leave your legal opinions to those of us who pay our bills, and funded the purchase of our Gen V, by practicing law. The following is a good basic outline for the elements to sue under the common law tort action for "defamation":

"If someone damages your reputation by way of slander or libel, you may have grounds to sue for defamation. "Slander" is the crime of making a false, spoken statement damaging a person’s reputation. "Libel" is a false published, written statement damaging a person’s reputation. Some states combine libel and slander claims under the umbrella term “defamation.” Other states still distinguish between the two, requiring the appropriate civil suit for the respective offense. Defamation cases are notoriously difficult to win since the burden of proof is on the plaintiff to prove that a statement is defamatory and damaging. Even if a statement is defamatory, many cases (such as cases involving someone who is a public figure) require proving actual malice."

Clearly, the facts in this case do not support a law suit for defamation. First, there must be actual "damages", as with any tort cause of action. Good luck with that. In other words, the salesperson would need to prove that he actually lost sales of Vipers due to George's comments. Secondly, the salesperson needs to show that the statement made by George was false. It wasn't. Lastly, the salesperson needs to prove that it was malicious (i.e. the statement was made with the intention of causing the salesperson to lose Viper sales). Nothing in George's statement suggests that he was posting his comments with the intention of harming the salesperson. This case would be a loser. Period.

However, if George wants to sue you for "intentional infliction of mental suffering", which is similarly a tort common law cause of action........... I'll just let you digest that thought.

On a brighter note, beautiful child, and nice car George!!!! Don't let a few paint chips and a small crack in the stryker logo ruin the experience for you.

EDIT - BTW WANTED, you missed "of" before "what"; "your" should have been "you're"; and, lastly, "you" should have been "you're" as well. Three grammatical errors in two sentences. Really??????? You need to gain a mastery of the English language before you start implying the threat of legal proceedings, and the salesperson's action in defamation is meritorious.

Wanted, Flyboy999 basically laid you to rest for me but I will indulge your comments.

Are you related by blood to Sean O'Grady of Palmer Dodge in GA who I purchased the car from? Opps I guess thats another lawsuit. Even though I named my sales rep, my intentions were strictly to inform anyone here looking to purchase a new Viper to avoid this dealership's sale rep Sean O'Grady due to my personal experience dealing with him on a $100,000 automobile that was misrepresented and the lack of communications on his part. If I can save someone else here the trouble of going through what I am then its all worth it. By the way, this is my third Chrysler/Jeep/Dodge vehicle I purchase.

I have a transport pre inspection document signed by Sean right before the driver began to load the car. It shows the damage on the car and its discerption. Why didn't Sean give me a call to inform me of the missed damage on the car that the transport driver noticed upon his examination??? It would have just took a second to call me and notify me. The reason he didn't call me was because he knew I would have not accepted the car with the damage. Its his responsibility to inform me of the damage, not the transport driver.

To educate you a bit on charector lawsuits since I deal with attorneys almost on a daily basis, you must prove all of the following,

There's been a statement made of you that is all of the following:
-Published
-False
-Injurious
-Unprivileged

By the way Wanted, I've also left negative reviews on Google and Yelp. So please inform him of that when you talk to him.

Now back to my experience. Sean has still yet to return any of my texts, emails, and voice mail. After multiple days of avoiding me in regards to the damage on the car, I get a call from his sale manager who is unaware that Sean knew about the damage on the car yet did not inform me. Wanted if you would like, I am more than happy to share Sean and I's text messages where he states multiple times that the car has "zero damage, scratches and swirl marks". I point out to him multiple times that the add online shows a car with swirl marks all over to which he states that the pictures were taken right after the "protective tape" was removed off the car from transport and that the car was cleaned up and has no swirls in the paint. At one point, Sean gets upset at me for questioning him again about the cars condition stating "haven't I assured you enough that the car is perfect".

So now I have Dodge involved with the incident as they have contacted the dealerships GM of the experience. The sales manager is supposed to be calling me today with information on returning the car should I decide to do so. My plan is to take it to my local dealership to get anode what replacing the rear cracked brake light involves.

SRT customer service rep Veronica has been AWESOME and helping through this entire process. Yesterday she gave Palmer Dodge a call personally and told them that if they did not return my calls there would be escalation with them getting involved. Needless to say I got a call shortly after from the sales manager and he was shocked that I had not received my tags yet which were to be overnighted last weekend which should have been on the car when it arrived. When I asked the sales manager "what I did to deserve this kind of treatment" he didn't know what to say but that it wasn't my fault and that I did nothing wrong.

As for the Viper GEN V, it is an awesome machine and even though I have yet to drive it due to my tags still not arriving, my kids and I love it and hopefully can get everything sorted out before summer is over. For now my son and I just sit in the driver seat and pretend we are cruising.

7TH you did nothing wrong buy trusting the sales guy and the dealer, they screwed up, it will all work out. You have an Awesome car and a great family,and that trumps anything that wanted has to say.:usa:

Nobody's gonna sue anybody for defamation you blithering fool. He trusted someone's word and got burned. The salesman dropped the ball...and I'm sure others were involved in the misrepresentation. You just sit around spring loaded like a Jack in the Box, just waiting to whine about something. Piss off.

Guys thank you all.

I have some great news to share with you! My tags arrived today finally. So I decided to get the ball rolling on the repairs.

I just got back from the dealership near me. What a great experiance. Troy took time out of his schedule to allow me to come in and have his Viper tech Jon look at the light. Jon took a look and said I'll be right back. So i'm still thinking the entire carbon fiber panel has to be removed along with the sealant holding it a big process. Jon comes back and informs me he has good news that there is a small screw that is holding the center brake light with the Viper logo all you need to do is remove the screw and the light assembly pops right out!!! It's that easy! Troy couldn't belive how Plamer Dodge treated me. I'm glad I'm in good hands now.

I gave Troy and Jon a big high five just due to how happy I was to hear the news. Troy ordered the part and I'll be taking it back in for replacement.

The day continues to get better as I stop by a detail shop ViperSmith recommended. I meet the owner Dave and he looks over the car. He informed me that the swirls and holograms in the paint were caused by an inexperienced indivual using a porter cable. However he said he can correct all of it. Hopefully Palmer Dodge agrees to cover the bill.

This was also the first time I drive the car and what an enjoyable ride. I love this thing!

Nice car... Sorry you went through some crap.

I bought my car sight unseen too from some crappy cell phone pics lol. Was assured it was perfect- and it pretty much was.

A gamble.

It's all good. At the end of the day you have to either trust people or not. There is no way in hell id buy a 90k car from a kid salesman. Id want the best I could find, the most knowledgeable and trust worthy salesman. Id ask others who have bought Vipers where a good reputable place to do business would be. I spent easily 12-14 hours on the phone with Bill Pemberton over the course of a couple months and I knew this was the guy who would do me right. He came through more so than I could have ever imagined. I bought Bob Woodhouse's personal 2013 Viper GTS. You can imagine the condition it was in.

Shame on the dealer for letting a rookie salesman handle you're deal, and shame on you for not doing better research. It's that simple.
You bought a car. It's just a car. An expensive one but your not married to it.

Mentioning the Salesman's name? Maybe not the most wise or most courteous thing to do. You can't blame the kid for just wanting to get the sale to try and pay rent (probably). Steering clear from *** Dodge dealership would have been the gentlemanly thing to do.

Anyway, I hope you get all the errors corrected- and wish you many miles and years of wonderful Viper ownership.

It wasn't too bad. ViperJeff didn't have to come in with a broom. WANTED got ******* slapped across the face and scampered off. OP finally got his car squared away and balance was restored.

Guys. Another update. The Vice President of Palmer Dodge called me today. Jody Cruz took the time out his day to call me after Dustin explained to him my experiance with Sean and the condition that the car was in upon receiving it. Mr. Cruz apologized for Sean's mistakes. He agreed to pay for the paint correction to the car. He also informed me he was on his way to the dealership to have a conversation with Sean.

It took some time and effort but all is well now and I'm very happy with how Dustin and Jody came through for me.

I guess Sean will be learning a lesson about disclosing the truth and returning customer's calls. If one of my employees treated a customer that way, they'd be fired or damn close to it! He clearly did not have an honest approach with this sale. Avoiding a customer's concerns/calls is the quickest way to piss off a guy who just spent 100K with you!...more than a lot of people spend on a house...at least here in the backwoods of Nebraska! hhaha.

I was keeping an eye on this thread and learned a thing or two about defamation in the process.

Appreciate everyone working through and getting this thread back on track.

Most importantly, glad to see the issues with car will all be corrected.

Isn't it weird how "Sean" is pronounced Shawn? Looks like "seen" to me...
I always have heard it as shawn (as in 007 Connery) until the local weatherman showed up pronouncing his own name, Sean, as "seen". That sounded wrong to me. :)

LOL. I call BS on this. No one, especially guys on a viper site "feels" sorry for anyone. They get a twitch in their stomach for a few seconds and move on to whatever **** site they choose lol. I don't think a guy pointing out that a salesman was disingenuous on a sale is a boo-hoo moment and you have it backwards. If he were buying a used Honda civic I would agree, but a car salesman damn well knows that a car like this the buyer is going to be picky and he asked specific questions and was mislead. Is that a surprise? No...

you say OMG, lol. every car i have purchased never has this happen to me. why? because i did my due diligence , knew what to look for , knew a fair price and ALWAYS TALKED TO WHO WAS IN CHARGE OF THE DEALERSHIP, DAH! Basic :nono:
