I'm assuming you have a deposit on the car? If so, they can't do that. If you did not leave a deposit, then high bid gets it. Do you have a purchase agreement with them?

Have purchase agreement from 2/02. Leasing company has been dealing with them for years. My certificate says the lease company paid $100 deposit.

Have you called the leasing co, have you called the dealership?

I would also contact Ebay perhaps they will stop the auction before it is too late.

Does the person selling it actually own it ? Seller rating of ZERO I would think Hillsdale Dodge would have sold on Ebay before

Pauls, it wouldn't hurt to let the buyer know that you have a security deposit already placed on this car and you will contest the sale of this car. If I was the bidder on an $83K+ car, I'd probably cancel my bid and move on to the next one. JMHO

If it were me - Notofy the high bidder, ebay, and seller of your intention to protest the sale before it closes. Contact DC and your Lease Company (I would get conference call) and be civil - explain to them that you want this problem sorted out quickly and queitly but you have no fear about getting your lawyer involved. You could also check with the Better Business Office in your area to see if you have solid ground to stand on.

BE QUICK!!! 4 days left before you could be in a serious position.

Or you could be an *** and bid $150k then let him try to sue you for the money....

I like Bonkers idea, High bid it on a NEW SIGN IN(incase your an Ebayer), then deal with them. Gives you an extra week or so.

i emailed them asking whats up, heres what their reply said,

Thanks for the question.

The person who is claiming to be the victim of "Viper theft" is not
forthcoming about all that's taken place.

Rest assured, some stern facts exist about the original Viper order:

1. To this day, we have never received any money towards a deposit from
the gentleman or his broker and there is no agreement.
2. DaimlerChrysler has been very firm with us, the dealer body, about not
selling these vehicles to brokers.
3. Within weeks of the vehicle's arrival, the client (through his broker)
told us he was no longer interested in the vehicle. The broker, however,
still wanted the vehicle. We told the broker he was not eligible.
4. After the vehicle arrives, the broker and the client strike a deal for
a "few months" lease, then they would together sell it on EBAY and split the
profits. We brought this to DCX's attention and 2 levels of management
said, "NOPE".
5. The client, who at this point would still never speak to us directly
(ever), stated his intention to put both himself and the broker on the
title. The broker, mind you, had previuosly bounced two $70,000 checks to
us within the past 19 months.
6. The dealer continues to pay floor plan interest on the $80,000 Viper
and , of course, never had clients waiting in the wings for the car because
of how DCX originally handled the orders for the Vipers. The dealer now
has decided to move past the mess and sell the car. DCX is very well aware
of this entire issue.

Greed, in this case, has to do with the broker and the client. It's very
unfortunate, but it's time to move the car.

Rustman is a shill for Hillsdale. His facts are BS.
Lease Co (Ie Broker according to dealer) contacted me the week it arrived. Unless MR Grossheim has a memory problem I've called him no less than a dozen time, (want to see my phone records?) VCA has called him several times.
When I originally accused them of trying to take my car, they said if I didn't take it, it would go back in the pool. Dodge would send it to another certificate holder. Hillsdale has been talking out of both side of their mouth since my fist call to them.

They (Hillsdale) say they can't title to my lease co. They want me to buy it pay taxes and sell to lease company. Hell that's why I'm leasing, so I only pay on what I use!!Lease company is a reputable name, former president of OHIO VCA and long time customer of dealer buying dozens of cars from them. Now I don't know what went on with Hillsdale and the Lease Co. But they say it's a thrid party title transfer and Dodge won't allow it. VCA/ Fiona gets involved to appease dealer and there concern of retribution from Dodge. That gets handled. Lease company calls to plan payment.
We Plan to send a truck to pick up car. Now Hillsdale says we decided not to sell to you.

Now, the dealer is doing exactly what they proported to be concerned about, BROKERING. Car is on ebay. Bids are from wholesalers.

Ask the VCA. I've been on this since the lease co said there was a problem. The statement I refused the car is an outright lie! I refused to buy it and sell to the lease co.
Who is the dealer to hold court on who my lease company is. For that matter who is Dodge to tell me this. I have a Buyer agreement signed by Rob Grossheim of Hillsdale.
My certificate says $100 deposited. The lease company made the deal 2/18/02.
I've got the paperwork. So this guy is full of it.

It seems you paid the leasing co so your contract is with them not the auto dealer.

Have you called the leasing co, have you called the dealership?

The leasing company has called Mr Grossheim as many times as I have. I know nothing about the Lease Company's relationship with Hillsdale. I provided my certificate to the lease company and they struck the deal with the dealer. My name is on the Certificate and the buyer's agreement signed by Hillsdale. I have a lease agreement with the lease company.

I do know the Lease Co has bought dozens of Vipers from them and leased them in the same method I'm trying to do. Right now all I know is what Hillsdale tells me. They have said nothing about a problem with the Lease Co.

I do know that DC has made it clear. You have to title in your name. It is not impossible to title in your name, pay and then have the lease co. pay you back when you start the lease program.
I know that my dealer asked for more than a $100.00 bill even though all dealers are different. I know of a couple that have had titles flipped but the title went into the Cert. holders name then flipped to the one that actually wanted the car. Some have made thousands by turning the Viper and this is why you are having the hard time, they feel that all you want is a few thousand and not a new 03.

I agree with jkracer9. A $100 deposit seems rediculously low on an $80,000 plus car. When I bought my FE GTS from Rob Grossheim at Hillsdale I placed a $5,000 deposit. Again, my transaction with them was very smooth. There is something fishy about this whole deal and I think we are missing some information.
Everyone on this board seems very quick to jump on the band wagon against a dealer without having all of the facts. This case is a prime example. I hope whichever side is telling the truth ends up on top on this deal.

If the dealer accepts it, a $100 deposit is as good as a $5000 deposit if the correct paper work was done. I see $500 deposits on $100,000+ property contracts all the time. If you were a buyer wouldn't you want the lowest deposit...."just in case"? The deals I have seen on here about most dealers have been true, especially on the SRT10 cars. I am on this board WAY to much and after I see hundreds of posts over many months from someone I feel like I know them. I consider almost everyone that has been here awhile a friend and UNTIL proven other wise I will take their word FIRST. I don't think DC would care if a leasing co or the buyer had their name on the title.....The dealer is worried about that but not selling to the highest bidder ????? Strange huh

Thanks for the support. I don't think a deposit is an issue. Would they care if I defaulted on the deal? Just look what they have done anyway!!

I don't have the car! Assume they panicked and sold it to one of the bidders before VCA or I could get involved. I've been traveling for three days and haven't heard what if anything the VCA did for me. It's mysteriously quiet everywhere.
Next steps are to deal with the dealer if I don't have a car.
