The bastard didn\'t have insurance

He had a lapse in coverage the day ran the stop sign and crushed my rear quarter. He went and renewed the following day.

Is it a stupid question for me to ask, am I screwed?

If your policy has an uninsured motorist provision, no. Otherwise, you can still probably get your insurance to cover and they will go after him to recover their expenses. At least that has been my experience. Good luck!

HOLY ISH! I had a funny feeling when I was talking to you the other day chuck. But I am sure you have un-insured coverage and in the event you don't...did you get a police report? It would help in the event your ins company goes after him for the repair cost.

Your policy should pay under your collision coverage. Your company can then pursue the responsible party for the outlay made to you, via subrogation. They may elect to have the responsible party sign a promissory note which is simply a promise to pay the funds back, say $100 per month. You get your collision deductible back once all the funds are paid in full.

uninsured coverage refers to personal injury protection and does not cover property damage.

If you have collision, whether or not he has coverage won't matter to you. (except you will most likely not recover your deductible)

If you don't have collision, you may be screwed. You can sue personally, but collecting is near impossible. Some states, like NY, will revoke a driver's license if they have a judgement for damages resulting from an uninsured motor vehicle accident until paid in full.

Maybe the parents can just pay you for it right away. Tell them you need a payment within 5 days. If you don't get it, or they give you attitude, sue.

Your neck may be starting to tighten up a bit, isn't it? and I know you didn't take any pictures of the bruises but I am sure they hurt just the same...

I may have missed this in your original post Chuck but was a police report made out? Is it clear that the accident was his fault (I realize that it was but I am referring to proof such as witnesses or statement to police)?
Without such evidence, he could claim that you ran the stop sign.

Yes there is a police report and yes, he admitted to running the stop sign. The car is in his parents name. I will find out next week what I'm going to do.

How long can you wait to drive your Viper? If you can avoid repair under your collision policy your better off. A claim is a claim and insurance doesn't like to pay out.
State Farm has an unwritten, "three strikes in two year policy" which leads to review and reassess.

Go get em Chuck. I'd start the pressure on them (kid and parents) Monday a.m. and don't let up until paid. All legal like and such but I wouldn't let them get this situation out of their mind. Constant mental stress can be a very powerful motivator. I'm not talking stalking here, just don't let the situation slide for one minute. Somehow, I don't think you will.

What is damaged? Do you already know how much repair will cost?

It's a good thing over here, you can't register your car if you're not insured.

It's good it's in the parents' name as they're likely to have more assets than the kid.
In general, your insurance rates should not go up if the accident is the fault of the other party (police report). The only thing you'd get stuck with is the deductable and you could theoretically go after the car owners for that...may not be worth the time/effort depending upon the amount. Could perhaps do it in small claims court.

In CA., State Farm, Uninsured motorist (U), is Medical, U1, is property damage.
My policy only covers 5K on the U1, cost is less than $20 for 6 months. I know 5K is not much, but as posted your collision will cover you as well.

Also, you can take your car to any shop you want (in CA.), Dont know if the laws are different in your State.

Chuck, when I turned 18, I went to insure my car, and they wouldn't let me since I was not a registered owner.
If his name is not on it, and it is in his parents name, go after their insurance.

Yep, if it is in his parents' name, it's their liability. Weird huh?

Regardless, you provided the at-fault party to your insurer, why are they not telling you to go get it fixed and send the bill? That's what I've always encountered... "get it fixed, send us the bill, when we get paid, you get the deductible back".. sometimes even without the last bit!
